Muntinlupa Mayor Jaime Fresnedi said the City Treasurer’s Office followed all the rules and regulations under the law when it auctioned off a delinquent Ayala Alabang Village property in 2016.

Fresnedi and City Treasurer Anastacio Miñoza made the clarifications during the flag-raising ceremony at the city hall on Feb. 15 in response to the accusations made by spouses Manuel and Maria Lourdes Alberto whose 450 sq. m. house on Dama de Noche Street in Ayala Alabang Village was sold by the city government at a public auction on Dec. 7, 2016 after its real property taxes amounting to  P323,026.70 were not paid for seven years from 2010.

The Albertos sent a letter to the Presidential Anti-Corruption Commission last December to seek investigation regarding the auction of their house.

In a statement, Manuel Alberto said they did not receive any notice from the City Treasurer’s Office about the real property taxes and foreclosure of their property.

Fresnedi said the property was auctioned off because it was delinquent and that notices were sent to the address indicated in the tax declaration.

“Una ay bakit po napa-bid ang auction dahil delinquent ang property. For the past seven years, delinquent. Hindi po nagbabayad ng amelyar. So bago po ipublish naman iyon, may mga notices na pinapadala doon sa address na nakalagay sa tax declaration (First, the auction was held because the property was delinquent. For the past seven years, delinquent. No real property taxes were paid. Before the (notice of auction) was published, there were notices sent to the address indicated in the tax declaration),” said Fresnedi.

He added, “And then, ito po ay tatlong beses na na-publish sa newspaper of general circulation. Ibig sabihin yung newspaper of general circulation, ito po ay mababasa sa buong Pilipinas (And then, it was published three times in a newspaper of general circulation. Newspaper of general circulation means that it will be read all over the Philippines).”

“Sumunod sa patakaran o sa proseso na itinatadhana ng batas. At bago ho ito ma-auction din, ito ho ay ipino-post sa lahat ng mga barangay hall. Barangay hall ng Ayala Alabang, bawat barangay ng City of Muntinlupa (The rules or processes mandated by law were followed. Before this was auctioned, (a notice) was posted in all barangay halls — barangay hall of Ayala Alabang and every barangay in the City of Muntinlupa),” the mayor said.

Fresnedi explained, “So pagkatapos din po ng auction, nino-notify pa rin po iyan. Ibig sabihin, lahat ng proseso na itinatadhana ng batas para magkaroon ng isang balido o ligal na pag-auction ng isang delinkwenteng property ay sinunod ng ating treasury. Yan po ang issue. Ibig sabihin din po na hindi ho yung scam, meron daw sindikato, connivance with the bidder. (So after the auction, they are still notified. This means all the processes mandated by law to have a valid or legal auction of a delinquent property were followed by our treasury. That is the issue. This also means that it is not a scam, that there was a syndicate, connivance with the bidder).”

At the flag-raising ceremony, Miñoza said, “We complied with all the procedures, requirements from three notices, and notice of delinquency through registered mail.”

“During the conduct of the public auction, that was the only time that the bidders became known to me. I never talked to them,” he said.

The bid price for the Alberto property was P5 million and the proceeds of the auction, less the real property taxes owed to the city, will be given to them.
